Please read these Terms of Service ("Terms") carefully before using the Atelier Masterclass web application ("Service") operated by Atelier Masterclass ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Atelier Masterclass is an AI-powered studio assistant for fine art painters. It provides tools including AI mentor chat, reference image generation and analysis, colour palette management, painting plan generation, digital notebooks, and a personal archive gallery.

3. Subscriptions and Credits

The Service operates on a subscription and credit-based model:

• Subscriptions: Monthly (€15/month) or Annual (€149/year), each including 400 Studio Credits per billing period.
• Monthly credits reset at the start of each billing cycle and do not carry over.
• Additional credit packs may be purchased by active subscribers. Purchased credits do not expire.
• Credits are deducted for AI-powered actions as specified in the platform. Non-AI features (notebooks, gallery, Drive workspace) are unlimited.

4. Payment and Billing

Payments are processed securely by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods or unused credits.

5. Fair Use

The Service is intended for individual personal or professional use by fine art painters. You may not:

• Resell, sublicense, or redistribute access to the Service.
• Use automated scripts or bots to consume credits or access the Service.
• Use the Service to generate content that infringes intellectual property rights or violates applicable law.

6. Intellectual Property

Content you create using the Service (reference images, painting plans, palette records) remains your property. You grant us no rights to use your content. The Atelier Masterclass platform, branding, and underlying technology remain our exclusive property.

7. AI-Generated Content

AI-generated reference images are provided for your personal painting reference use. We make no warranties regarding the uniqueness, accuracy, or fitness for any particular purpose of AI-generated content. You are responsible for how you use AI-generated content.

8. Google Services Integration

If you choose to connect your Google account to use Drive & Docs features, you do so subject to Google's Terms of Service and Privacy Policy. You may disconnect Google access at any time.

9. Limitation of Liability

To the maximum extent permitted by law, Atelier Masterclass shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive to provide a reliable service but cannot guarantee uninterrupted availability. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice.

11. Termination

We reserve the right to terminate or suspend your account if you breach these Terms. You may terminate your account at any time by cancelling your subscription and contacting us.

12. Governing Law

These Terms are governed by the laws of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
